By accessing and using the CourtPilot website at www.courtpilot.co.uk (the "Service"), you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance.

2. IMPORTANT DISCLAIMERS

2.1 NOT A LAW FIRM

CourtPilot is NOT a law firm, law office, or legal services provider. We do not employ attorneys and do not provide legal advice.

The information, documents, and analysis provided by this Service are for informational purposes only and do not constitute legal advice. They should not be relied upon as a substitute for professional legal counsel from a qualified solicitor or barrister.

2.2 AI-GENERATED CONTENT

Content generated by our AI systems (case analysis, document drafting, strategy recommendations) may contain errors, omissions, or inaccuracies. You are responsible for independently verifying all information before relying on it or submitting it to court.

  • AI analysis reflects current information at the time of generation
  • Law changes frequently; always verify with current legislation
  • AI cannot account for all individual circumstances or case nuances
  • Court bundles and documents must be reviewed by the User before submission

2.3 PROFESSIONAL CONSULTATION REQUIRED

For complex cases, defended claims, or high-value disputes, we strongly recommend consulting with a qualified solicitor. If our Service flags your case as "complex" or "high-risk," this is a recommendation to seek professional legal representation.

2.4 NO GUARANTEE OF OUTCOME

We do not guarantee any specific legal outcome, judgment, settlement, or court decision. Success depends on facts, law, evidence, and court discretion, none of which we control.

3. Your Responsibilities

3.1 Accuracy of Information

You warrant that all information you provide (case details, documents, personal data) is:

  • True, accurate, and complete
  • Not misleading or deceptive
  • Legally obtained and you have the right to provide it

You are solely responsible for the accuracy of your case information and supporting documents.

3.2 Document Authenticity

All documents you upload (contracts, invoices, emails, correspondence) must be:

  • Original or certified copies (as required by court rules)
  • Authentic and unaltered
  • Properly dated and sourced

You certify that documents are admissible as evidence and comply with court rules. Submitting false documents is perjury and a criminal offence.

3.3 Court Compliance

If you submit documents or bundles to court, you must:

  • Review all documents before submission
  • Comply with Civil Procedure Rules (CPR) and court orders
  • Meet all filing deadlines and formal requirements
  • Include required declarations and declarations of truth
  • Serve opposing parties correctly and on time

Failure to comply with court rules can result in sanctions, strike-outs, or adverse judgments.

3.4 Intellectual Property

You retain all rights to documents and information you provide. By using the Service, you grant us a limited license to:

  • Process and analyse your documents
  • Store your information securely
  • Generate recommendations and advice
  • NOT train AI models or share data with third parties without consent

4. Service Tiers & Usage Limits

4.1 Free Tier Limitations

The Free tier is designed to allow you to assess the Service before committing to a paid plan. Free tier users are subject to the following usage limits:

  • Cases: Maximum of 1 legal case may be created
  • Documents: Unlimited document uploads within your case
  • AI Legal Chat: Maximum of 2 questions total (lifetime limit, not per day)
  • Features: Access to free claim strength assessment, legal issues identification, court fee estimate, and CPR compliance check

Purpose: These limits prevent service abuse whilst allowing genuine users to evaluate the platform's AI capabilities. Once limits are reached, you will be prompted to upgrade to a paid tier for continued access.

4.2 £97 Lifetime Tier Limitations

The £97 Lifetime tier provides comprehensive access to all premium features for a single legal case. This tier includes:

  • Cases: Maximum of 1 legal case may be created
  • Documents: Unlimited document uploads within your case
  • AI Legal Chat: Unlimited questions to our legal AI assistant
  • Premium Features: Full access to AI document analysis, court-ready bundles, witness statements, legal letters & correspondence, and comprehensive case analysis
  • Lifetime Access: One-time payment with lifetime access to your case and all features (no recurring fees)

Note: This tier is designed for individual claimants pursuing a single small claims case. If you need to manage multiple cases or require enhanced features, please contact us about Custom Pricing options.

4.3 Custom Pricing

Custom Pricing is available for users who require:

  • Multiple Cases: Ability to manage more than one legal case
  • Law Firm/Solicitor Use: Professional use for representing multiple clients
  • White-Label Solutions: Branded platform access for legal service providers
  • Enterprise Features: Advanced reporting, team collaboration, and priority support

Separate Terms Apply: Custom Pricing customers will receive a separate service agreement with tailored terms and conditions. Contact privacy@courtpilot.co.uk with "Custom Pricing Inquiry" in the subject line.

4.4 Fair Usage Policy

We reserve the right to throttle or temporarily suspend accounts engaging in:

  • Automated Access: Using bots, scripts, or automated tools to generate excessive API calls
  • Resource Abuse: Uploading extremely large files (exceeding 50MB) or generating thousands of documents per day
  • Service Resale: Using your account to provide services to third parties commercially without a Custom Pricing agreement
  • Multiple Account Abuse: Creating multiple accounts to circumvent case limits

We will notify you via email before any throttling or suspension occurs and work with you to resolve the issue.

5. Payment & Billing

5.1 Pricing

Pricing is displayed in GBP (£) and is subject to change with notice. Current pricing is available on our pricing page. All prices are exclusive of applicable taxes (VAT).

5.2 Payment Method

Payments are processed via Stripe. We do not store credit card details; Stripe handles all payment processing securely and is PCI-DSS Level 1 certified.

5.3 Refunds & Cancellation

  • Free Cases: No refunds available (one-time payment for case analysis)
  • Subscriptions: Cancel anytime; no refunds for partial months (future charges will be stopped)
  • Disputes: Contact privacy@courtpilot.co.uk within 7 days of payment for refund disputes

5.4 Overdue Accounts

If a subscription payment fails, we will attempt to retry. After 3 failed attempts, your account will be suspended. Failure to pay may result in legal action to recover outstanding amounts.

6. Acceptable Use Policy

You agree NOT to use the Service for:

  • Illegal Activity: Creating false claims, fraud, or violating any law
  • Abuse: Harassing users, staff, or opposing parties
  • Unauthorised Access: Attempting to hack, reverse-engineer, or circumvent security
  • Malware: Uploading viruses, malicious code, or harmful content
  • Spam: Uploading multiple cases to manipulate algorithms or test systems
  • Copyright Infringement: Uploading content you don't own or have permission to use
  • Impersonation: Pretending to be someone else or misrepresenting your identity
  • Defamation: Making false statements about individuals or businesses
  • Commercial Use: Using the Service for law firm services, solicitor referrals, or resale without license

Violations may result in account suspension, data deletion, and potential legal action.

7. Limitation of Liability

7.1 As-Is Service

The Service is provided "as-is" and "as-available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or meet your expectations.

7.2 Disclaimer of Warranties

We disclaim all warranties, express or implied, including:

  • Merchantability
  • Fitness for a particular purpose
  • Accuracy or completeness of information
  • Non-infringement of third-party rights

7.3 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Direct Damages: Lost profits, lost revenue, lost data, or business interruption
  • Indirect Damages: Consequential, punitive, incidental, or special damages
  • Adverse Legal Outcomes: Unfavorable judgments, settlements, or court decisions
  • Third-Party Claims: Claims by opposing parties, courts, or authorities

Liability Cap: Our total liability is limited to the amount you paid for the Service in the preceding 12 months.

7.4 You Assume All Risk

You use the Service entirely at your own risk. By using it, you assume all risk of loss, including financial loss, adverse court outcomes, and reputational harm.

8. Indemnification

You agree to indemnify, defend, and hold harmless CourtPilot, its officers, employees, and agents from any claims, damages, or costs (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your infringement of third-party rights
  • Content you provide or documents you upload
  • Disputes with opposing parties or courts

9. Data Protection & Privacy

Your use of the Service is also governed by our Privacy Policy and Cookie Policy, which explain:

  • What data we collect and how we use it
  • How we protect your information (AES-256 encryption)
  • Your rights to access, delete, and export your data (GDPR)
  • Use of third-party services (Google Analytics, Stripe, Sentry)

Important: Case information is NOT used to train AI models or shared with third parties without your explicit consent.

We may link to external websites (court websites, legal databases, BAILII). We are not responsible for their content, accuracy, or privacy practices. Use at your own risk.

10.2 Third-Party Integrations

We use third-party services for:

  • Payment processing (Stripe)
  • Analytics (Google Analytics, Google Tag Manager)
  • Error monitoring (Sentry)
  • Email delivery (Resend)

These services have their own privacy policies and terms. You are responsible for reviewing them.

11. Account Suspension & Termination

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms or our Acceptable Use Policy
  • Engage in illegal activity or fraud
  • Fail to pay fees
  • Harass staff or other users
  • Attempt to hack or abuse the Service

Upon termination, your data will be retained per our Privacy Policy and applicable law (6-7 years for legal cases).

12. Dispute Resolution & Governing Law

12.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to its conflict of law principles.

12.2 Dispute Resolution

Any dispute arising from these Terms or the Service will be resolved as follows:

  1. Negotiation: Contact privacy@courtpilot.co.uk in writing with details of the dispute
  2. Mediation: If unresolved within 30 days, either party may propose mediation
  3. Litigation: If mediation fails, either party may pursue legal action in the courts of England and Wales

12.3 Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be severed, and the remaining Terms will remain in full effect.

13. Changes to These Terms

We may update these Terms at any time. We will notify you of significant changes via email or notice on the website. Continued use after changes constitutes acceptance.
