How court fees on money claims work

The issue fee — paid when you start the claim, whether online through Money Claims / MCOL or on a paper N1 form. It is banded by the total you claim (including interest), from £36 for the smallest claims to £470 at the top of the small claims track.

The hearing fee — only charged if your case is actually listed for a hearing: £26 or £57 on the small claims track. If the defendant ignores the claim (default judgment) or settles first, you never pay it.

You claim the fees back — court fees are added to your claim, so judgment against the defendant includes them. Filing costs you cash flow, not money — provided you win.
