The hearing fee is paid by the claimant only when the court lists the case for a hearing. Claims that end in default judgment, an admission or a settlement never incur it.
Enforcement fees
A County Court judgment is not money. Collecting it has its own fees, each added to the debt:
- Warrant of control (N323): £96
- Attachment of earnings (N337): £139
- Third party debt order (N349): £139
- Charging order (N379): £139 plus the Land Registry fee
- Order to attend for questioning (N316): £69
Help with fees
If you receive certain benefits, or have a low income and savings under the threshold, Form EX160 (Help with Fees) can waive all or part of any of these fees. Apply before paying and quote the reference when you issue.
