How employment tribunal compensation works

Basic Award

Calculated like redundancy pay: years of service × weekly pay × age multiplier. Capped at £21,000. Only applies to unfair dismissal claims.

Compensatory Award

Covers actual financial loss (lost earnings, benefits, pension). Capped at £115,115 or 52 weeks' pay, whichever is lower. Uncapped for discrimination.

Notice Pay

If dismissed without proper notice, you're owed either your contractual notice period or statutory minimum (1 week per year of service, max 12 weeks).

Holiday Pay

Any accrued but untaken holiday must be paid on termination under the Working Time Regulations 1998.

Time Limit

Employment tribunal claims must be filed within 3 months minus 1 day of the dismissal or act complained of. You must start ACAS Early Conciliation before filing.
