What Form N323 is for

The form to send County Court bailiffs to take control of the debtor's goods to satisfy a judgment.

Who files it: The judgment creditor.

The official form is published by HM Courts & Tribunals Service. Download the current version from GOV.UK rather than reusing an old copy, because the forms change.

When to use it

The judgment debt including costs is £5,000 or less. Larger debts are transferred to the High Court for enforcement officers, unless the debt is under a regulated consumer credit agreement.
The debtor has goods of value at a known address, such as vehicles or business stock.

Deadline and fee

Court fee: £96 (EX50, 13 July 2026), added to the debt. (EX50 fee list)

If you are on a low income or benefits you may not have to pay court fees. Apply with Form EX160, Help with Fees. Fees you do pay are added to the amount the other side owes if you win.

How to complete it

Every County Court form follows the same rules: use the claim number exactly as it appears on the court’s letters, give full names and addresses for each party, write dates in full, and sign the statement of truth in your own name. A statement of truth is a promise to the court that the contents are true, and a false one is contempt of court.

What can bailiffs take under a warrant of control?

Goods belonging to the debtor, excluding basic household items, tools of the trade up to £1,350, and goods on hire purchase. They must give seven clear days' notice of enforcement first.

How long does a warrant of control take?

The court issues the warrant within days. Bailiffs then send the notice of enforcement and attend afterwards. Most warrants are resolved within one to three months, by payment or by a report that no goods were found.
